Civil law IP proceedings in Poland on the eve of a great change - specialized courts of intellectual property will be established.
On February 19th, 2020 the President of Poland signed the
amendment of the Polish Code of Civil Procedure introducing specialized intellectual
property courts in Poland. Most of the amended provisions will enter into
force on July 1, 2020. From that moment, intellectual property cases will be
heard by specialized IP courts only: 2 courts of appeal in Poznan and Warsaw
and 4 regional courts in Warsaw, Gdańsk, Poznan and Lublin (in place of the currently
existing 45 regional courts and 11 courts of appeal). Cases initiated before
the entry into force of the new provisions will continue according to the
The scope of matters covered by the new organization of the proceedings
is very broad, including:
of copyright and related rights,
utility and industrial designs,
of integrated circuits,
of other rights on intangible assets (intellectual property matters),
and combating unfair competition,
· the use of
a personal good for the purpose of e.g. advertising or promotion of an
entrepreneur, goods or services or in connection with scientific or inventive
The Regional Court in Warsaw will be exclusively competent in matters of
intellectual property regarding computer programs, inventions, utility models,
topographies of integrated circuits, plant varieties and trade secrets.
Foreseen amendment introduces new types of proceedings that will allow a
more comprehensive examination of IP disputes. Among others, the new bill
provides possibility to file counterclaims in infringement matters, with request
for invalidation or revocation of a trademark or for invalidation of an
industrial design. The new provisions cover
also requests for disclosing or issuing evidence held by the defendant, in
particular bank, financial or commercial documents concerning the infringement.
The amendment is widely considered as a positive change that will lead
to improving the quality of case law and its consistency.

JUDGMENT OF THE EU GENERAL COURT UPON AN APPLICATION FILED BY LDS HIGHLIGHTED IN TSUE ANNUAL REPORT FOR 2014
A precedent view of the General Court of the EU, on the rules for assessment of genuine use of 3D trademarks, presented in its judgment of 11 December 2014, in Case T-235/12, CEDC International sp. z o.o. / OHIM (Shape of a blade of grass in a bottle), upon an application for annulment prepared by the LDS team (Michał Siciarek and Jakub Mrozowski), has been highlighted in the current Annual Report of the Court of Justice of the EU as one of 13 important judgments regarding IP from 2014.
The above case related to the opposition against a CTM application for a 3D trademark based on earlier 3D trademarks – simple bottle with single blades of grass inserted inside. These trademarks were applied or registered without label, but used on the market only with label with other various word and graphical trademarks on the label. Due to the proof of use request presented during the proceedings, OHIM analyzed inter alia the issue of genuine use of earlier 3D trademarks. OHIM found that the opponent did not prove genuine use of the earlier 3D trademarks, basing its opinion on the analysis of images of trademarks as used on market in views from front only (where the label is visible) and finding that the label has overshadowed the blade of grass placed inside the bottle. OHIM did not take into the account new items of evidence submitted together with an appeal depicting images of the trademark as used on market in views from other sides (where label did not cover the blade of grass).
As a result of application for annulment prepared by the LDS team, the General Court of the EU has annulled the contested decision of the OHIM, presenting a comprehensive overview of case-law in favor of admissibility of the evidence submitted together with an appeal (in certain cases, like the one at hand), and additionally it shared the view presented by the LDS on the need to abandon the static (two-dimensional) vision while assessing genuine use of the 3D trademarks and the need to apply a dynamic (three-dimensional) perception, which takes into account views of these trademarks from various sides (see paragraph 65 of the judgment).

AGNIESZKA GAŁĄZKA-KUSZCZYK - SENIOR ASSOCIATE
Agnieszka Gałązka - Kuszczyk has recently been promoted to the position of Senior Associate. Agnieszka has been working for LDS for many years and throughout this time consistently expanding her knowledge and developing skills along the development of our law firm. In the course of cooperation Agnieszka has showed great potential to build and strengthen relationships with existing clients, while fully identifying herself with the values of LDS and fully realizing those values: distinctive quality of services, interoperability, which results in synergy and constantly striving for development.
Agnieszka is a graduate of the Faculty of Law and Administration at the University of Cardinal Stefan Wyszynski. She gained her experience in the legal department of one of the largest pharmaceutical companies in the Polish market, in the Ministry of Health and the Main Pharmaceutical Inspectorate. Agnieszka deals with pharmaceutical law, industrial property, copyrights and unfair competition, food law and the so-called borderline products (dietary supplements, cosmetics, medical devices).

JAKUB MROZOWSKI SPEAKER AT THE CONFERENCE
Jakub Mrozowski, attorney-at-law with the LDS law firm, was a speaker at the conference on current legislation and case-law in the field of intellectual property in Europe: "Current IP Legislation and Case-Law in Europe". The conference took place in Prague on 28 November 2012 and was organized by the Licensing Executives Society Czech Republic.
The conference was attended by speakers from Russia, Slovakia, Hungary, Germany, Denmark and the Czech Republic, while Jakub presented the latest developments in the Polish legislation and case-law, noting the differences of the Polish system, current issues and latest tendencies.
INTA Roundtable will take place on September 28 in InterContinental hotel in Warsaw. The seminar is co-organized by LDS Lazewski Depo & Partners.
The topic of the meeting is: May 2012 reform of the civil proceedings 4 months on – more questions or answers? The purpose of this roundtable is to discuss aspects of the reform of the civil proceedings. As 4 months after the amended act was entered into force have passed by, it seems to be a good moment to discuss the effects of this reform. The discussion will focus on the enforcement, admissibility of evidence and case management.
The guest speaker at the meeting will be Beata Piwowarska – Judge, Chairman of the XXII Department, Community Trademarks and Industrial Designs Court.
Marek Lazewski will be a speaker at the FORUM conference "International Patent Litigation” - "Internationale Patentverletzungsverfahren" which will take place on October 8-9, 2012 in Mannheim.
The conference will focus around the issue of cross-border litigation, on some patent litigation jurisdictions such as Poland which is currently playing a role in establishing the community patent. Marek will address the issue of patent litigation in Poland, the past, present and future approaches to this issue , Courts in Poland to be preferred, number of cases heard, available remedies such as preliminary injunction, etc.

Marek Łazewski has recently been appointed Secretary of AIPPI Poland - National Group of the International Association for the Protection of Intellectual Property. AIPPI is a non-profit international organization which unites practitioners, academics and owners of intellectual property whose aim is to do research and formulate policy for the law relating to the protection of intellectual property.

LDS partners for the second time participated in Forum Corporate Legal Counsel organized by Blue Business Media, held on 28 and 29 February, 2012. Justyna Rasiewicz, legal adviser and Michał Siciarek, advocate gave their lectures.
Justyna Rasiewicz’s lecture approached the issue of trademarks protection from parasitic use of their repute and was based on the latest jurisprudence and the practice. Michał Siciarek’s lecture, in turn, concerned the issue of Intellectual property law in marketing activity and, in particular, the relationship with advertising agencies and other subcontractors, as well as contestants.

LDS Lazewski, Depo and Partners Law Office announce that in July 2011 Ms. Justyna Rasiewicz, Esq. has joined the Office as a Partner.
Justyna Rasiewicz is an attorney-at-law with long experience in handling contentious matters in the field of the intellectual property law as well as unfair competition. Justyna has handled dozens of litigations in that field, including patent cases, trademark, industrial design and plant variety right infringement cases and unfair competition cases. Justyna is advising clients also in contentious matters regarding validity of exclusive rights and preparing contracts on intellectual property rights.
Justyna is a co-author of The Commentary to the Law on Combating Unfair Competition published in 2011.
